Welcome to Hummbu. Throughout these Terms of Service, “we,” “us,” and “our” refer to Hummbu and HUMMBU INC.

Hummbu operates this website and store, including all related content, features, tools, products, and services (collectively, the “Services”), to provide you with an online shopping experience. Our store is powered by Shopify, which helps us operate the Services.

These Terms of Service (“Terms”), together with any policies referenced herein, describe your rights and responsibilities when using our Services. By accessing, browsing, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Services.

Placing an order through our Services constitutes an offer to purchase. We reserve the right to accept, reject, cancel, or limit an order at our discretion.

An order is not considered accepted until payment has been successfully processed and we confirm acceptance of the order. Please review your order carefully before submitting it, as cancellation or modification may not be possible once processing has begun.

If we change or cancel an order, we may attempt to notify you using the email address, billing address, or other information provided at checkout.

Returns, refunds, and exchanges are governed by our Return & Refund Policy. Purchases are intended for personal or household use and may not be purchased for unauthorized resale, commercial distribution, or unlawful export.

Section 4 — Pricing and Billing

All prices, discounts, and promotions are subject to change without notice. The price charged will be the price displayed when your order is submitted and confirmed in your order confirmation email.

Unless otherwise stated, displayed product prices do not include applicable taxes or shipping charges.

You agree to provide accurate, complete, and current billing, payment, and account information and to update that information when necessary.

By submitting payment information, you represent that:

  • The information you provide is accurate and complete;
  • You are authorized to use the selected payment method;
  • You authorize us and our payment processors to charge the applicable amount; and
  • You will pay all applicable charges, including shipping fees and taxes.

Section 5 — Shipping and Delivery

We currently ship only within the United States.

Processing and delivery times are estimates and are not guaranteed. Actual delivery may vary depending on product availability, destination, carrier operations, weather, holidays, or circumstances beyond our reasonable control.

We are not responsible for delays caused by carriers, incorrect shipping information, weather events, or other circumstances outside our reasonable control.

Once an order is transferred to the shipping carrier, title and risk of loss may pass to you to the extent permitted by applicable law. Please review our Shipping Policy for complete processing times, delivery estimates, charges, and shipping conditions.

Section 6 — Intellectual Property

All content and materials available through our Services, including text, images, graphics, videos, audio, trademarks, logos, product names, design elements, and overall website layout, are owned by Hummbu, HUMMBU INC, our affiliates, licensors, or content providers and are protected by applicable intellectual property laws.

Section 9 — Relationship With Shopify

Our store is powered by Shopify, but all sales and transactions are between you and Hummbu.

By using our Services, you acknowledge that Shopify is not responsible for any aspect of your purchases from Hummbu, including product issues, delivery issues, customer service matters, refunds, returns, or related claims.

To the fullest extent permitted by applicable law, you release Shopify and its affiliates from liability arising from your transactions with us.

Section 10 — Privacy

Personal information collected through our Services is handled in accordance with our Privacy Policy and, where applicable, Shopify’s privacy practices.

Because our store is hosted by Shopify, some information may be processed by Shopify and shared with service providers or partners to operate, protect, and improve the Services.

By using our Services, you acknowledge that you have read and understood our Privacy Policy.

Section 11 — Feedback, Reviews, and User Content

If you submit suggestions, reviews, comments, photos, ideas, or other content (“Feedback”), you grant us a worldwide, perpetual, royalty-free, transferable, and sublicensable license to use, reproduce, modify, publish, distribute, display, and otherwise use that Feedback for lawful purposes, including marketing and commercial purposes.

We are not obligated to keep Feedback confidential, pay compensation for it, or respond to it. We may remove or edit Feedback that we consider unlawful, offensive, infringing, misleading, or otherwise inappropriate.

We may limit, block, or restrict automated access at any time.

We may suspend or terminate your access to the Services, with or without notice, if we reasonably believe you have violated these Terms or used the Services in a manner that may cause harm.

Termination does not affect obligations or provisions intended to survive, including intellectual property, feedback, disclaimers, limitation of liability, indemnification, and governing law provisions.

The Services and products offered through them are provided on an “as is” and “as available” basis, except where expressly stated otherwise.

To the fullest extent permitted by law, we disclaim express and implied warranties, including warranties of merchantability, fitness for a particular purpose, durability, title, non-infringement, and availability.

We do not guarantee that the Services will be uninterrupted, secure, timely, error-free, or free from viruses or harmful components.

Some jurisdictions do not allow certain warranty limitations, so portions of these disclaimers may not apply to you.

To the fullest extent permitted by law, Hummbu, HUMMBU INC, our affiliates, officers, employees, agents, contractors, service providers, licensors, and Shopify and its affiliates shall not be liable for indirect, incidental, punitive, special, consequential, or exemplary damages, including loss of profits, revenue, savings, data, goodwill, or replacement costs arising from your use of the Services or products purchased through them.

Where limitations of liability are not permitted, our liability will be limited to the maximum extent permitted by applicable law.

You agree to indemnify, defend, and hold harmless Hummbu, HUMMBU INC, Shopify, and their respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from claims, liabilities, damages, losses, or expenses, including reasonable legal fees, arising from:

These Terms, together with the policies and rules posted on this website, constitute the entire agreement between you and Hummbu regarding your use of the Services and supersede prior agreements or communications relating to that use.

Our failure to enforce a right or provision under these Terms does not constitute a waiver of that right or provision.

Section 21 — Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent.

We may assign or transfer these Terms and our rights or obligations, including in connection with a merger, acquisition, restructuring, or sale of assets.

Section 22 — Governing Law

These Terms and any separate agreements through which we provide Services shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to conflict-of-law principles.

Any dispute arising from or relating to these Terms or the Services shall be handled in the courts located in the applicable jurisdiction of Colorado, United States, unless otherwise required by applicable law.

Section headings are included for convenience only and do not affect the interpretation of these Terms.

We may update or revise these Terms by posting an updated version on this page.
